So I was just wondering I got a ticket for Careless Driving (Donuts) and also a seatbelt ticket even though I had mine on. Don't feel like getting started on the story it was kind of my friends fault since he told me to do it but I was the one that went through with it. But anyway this is my first offense, do you think if I show up in court I could get the 2 pts dropped off my license?

Not trying to bust your balls, but this is your fault and yours alone.
Now with that being said, here in Florida if you take the driving class you don't get points and your insurance cannot go up under law. Dunno how NJ is though.

on your car?
I wouldn't go to court and risk getting points on your record.
The smart thing to do would be to pay a attorney to show up
in court for you.The attorney will only charge a small fee to show
up in court for you.A attorney will probably get your tickets dropped
down to a fine without any points on your record.Points on your
record will effect you later in life remember that.
The best of luck in this mess.

if you haven't use that driving class, you should be able to take that instead of getting hit with the points. you'll have to try and see if your lucky.

BTW was this in Nutley? or else where?
and try to stay away from Verona, in the last 2 days just driving through to get to West Orange, i've seen 5 cars pulled over. 2 being Mustangs, all the cars being pulled over on bloomfield ave by the park. i think they have a hard on for tickets this week.

I couldnt disagree more; If you show up in court the fine will be lowered, and you have the choice to take a driving class or not. Why on earth would you pay an atty to do the same thing your going to do? As well as have to pay the fine. This ticket is NOT going to be thrown out, you may be able to have the seatbelt ticket dropped, but the reckless driving will stand, possibly lowered to a lesser charge. Also points on you record stay for 7 years here in cali, not sure about NJ so for 7 years it "Could affect your life" but I doubt it unless your a full time driver for a company. Pennywise I'm not tryin to bust your balls but that is not good info. My best friend is an attorney for the Orange county Da's office and he is the one who is saying not to waste the $500 - $1500 attorney retainer for a petty case. If you think this is wrong just call a local atty and ask them, more than likely they will tell you not to waste the money.
No the thing actually happened in belleville. Okay ill actually tell you what happened. So I went to Wendys because my friend was hungry and he wanted food, so when we were there, there was a bunch of kids that were all sitting around with there hoods propped. Now this is a pretty big parking lot. Well my friend was like go rip it by them and spin the tires a little and he kept on saying it and i finally gave in. I didnt even do donuts, all i did was somewhat of a drift and where the cops were i dont even think they saw me they just heard it, since when i was leaving was when they pulled in. Well anyway i got pulled over and the cop came up to me and he said oh your from Nutley and was like do this ****ing **** in your own town and stay the **** out of mine. Just to let you guys know nutley and belleville always had a big rivalry and crap and this guy probably still had one from when he was in HS and what not. So he comes back and he gave me the careless, i was kind of expecting that and then he gave me the seatbelt too, the whole thing is that me and my friend both had our seatbelts on, i tried to ask him why he gave me the seat belt and he walked away. Also on the ticket he wrote donuts. Well the good news i guess is that i know someone that used to work in the Belleville courts but now currently works in another neighbor court system and she is going to try to get me out of it. Also my friend who was in the car with me, his uncle used to be a very well known detective and he was also on the board of ed in my town. Donkey_Punch you might know his name, Vinnie Moscaritola.

id say go and fight it if you can. i did on two tickets, one the cop didnt show, so everything was dropped, and the second time the judge lowered mine to a minimum fine and no points. I say just go and plead your case, they cant give you any more than whats on the ticket.

So you did it in the parking lot? I don't know if the law varies by state but here in Michigan I don't believe an officer has authority on private property, this includes a business parking lot. I don't know what it is but everyone likes to rip around in Wendy's parking lots... but maybe that's because I work there. I think all my bosses hate my Mustang

Definitely see if any signs are posted in the parking lot about the laws. California parking lots have signs everywhere saying (basically) all laws are enforced in parking lots. Good thing you're not in California.

I was about to say the same thing.... A kid back in high school (not my friend just an idiot)was racing in a huge movie theater parking lot and hit another car. And they could not do anything because it was on private property. Just a thought, that I would look into.

In Michigan (and I'm sure just about everywhere else) if a parking lot is open to the general public then traffic laws apply. If a property damage accident occurs in a parking lot cops generally don't go out to take a report. I'd still fight the ticket, Danman. If you haven't been to court before, talk to someone who has experience about what you should do. Maybe the woman who worked at the court can give you the name of someone to talk to who could kind of go over the nuts and bolts of arguing and winning your case.

It's more like $50 - $100 here for their fee. It's worth that to not have to miss work and they can get it taken care of BEFORE the court date and get it over with.
Used to, you could just call in and talk to the prosecuting attorney on the phone and get out of it. They would double the court fee and drop it to a non-moving violation. Now you HAVE to get an attorney to plea bargain before it goes in front of a judge. Remember judges have good days, and bad days just like the rest of us. So it's a gamble I would rather pay $75 to not deal with.
See the thing that is pissing me off is that...yeah i know i did something wrong but to me it doesnt even seem like he saw it and he just heard it instead. I mean my car is loud and you can hear it from far away. Also i went back today there are not even any marks where I was. Also for him to right donuts on the ticket that is just plain old bull**** along with the seatbelt ticket. To be completely honest all I did was hit the gas and my back of my car went out a little bit, it didnt even create smoke. I mean I have my friend as a witness to, does that help at all? But trust me I still know that I should have probably got a careless but like I said above when he wrote donuts, it sounds like I was just sitting there smoking the parking lot up.

The police officer said that no tickets could be issued because it was a private lot and matters would have to be tended through our insurance companies. It's just the same with a Wendy's or whatever else, they can pull you over or tell you to knock it off or they can pull you over once you get onto a street for some BS reason to make you think twice about doing it again, but a ticket can't legally be issued.

how can anybody here give this dude a legitimate answer? we all live in different cities, towns, etc, which all have different laws. i got a ticket last week for not signaling when changing lanes and u know what: i'm just going to pay it. i'm not asking for advice and i'm not going to waste my time by going to court and hope that the prick who gave me the ticket doesn't show up. doing donuts or a drift or whatever u did in a parking lot full of people is just plain stupid and dangerous so just pay the tickets and move on. if your worried about points then take a defensive driving class. oh, the ticket i got last week was a $40 fine with a $50 surcharge. talk about bullsh-t!!!!!!!! how can a dam surcharge be more than the actual fine? only in NY i guess.

According to the ticket yourself, you are only contesting the careless driving due to a doughnut. Let the judge know the cop was not there and here is documented proof of the parking lot he CLAIMS I was doing doughnuts in.

Good Luck! And remember, they get all kinds of low life people in there. So dress nice, and be polite. When the judge talks, look him in the face and LISTEN. Show respect and sometimes they will show it back.
