If I do NOT cut and roatate the Intake

Ooops, me = dumb. FMIC = Front mount intercooler.

The only purpose to rotating the upper is to reduce the amount of work you have to do in fabricating the IC - Intake pipe. You shouldn't have any problems running with the stock hood.

Look at the readers rides on : http://www.40bob.com/

There are some pics of cars with FMIC without rotating the intake and still using the stock hoods. I think rotating is supposed to make the air travel shorter and less piping. Now I'm not sure if it helps perfomance but it makes your engine bay nicer looking :)

thanks guys, I can understand the routing and the shortest distance traveled for more than looks, I have heard that it may help in HP due to the lack of bends in the piping and less friction internally.

I have also heard that the upper can be difficult to re weld due to a casting issue. Is this true? and if so what other upper can do this easier?

Anybody that can weld aluminum can do it for you. Bob, http://www.40bob.com/ can do a real nice, no mistakes on angles job for you. There are some other negatives to rotating the upper intake though that I am aware of as I have one. Reaching the distributor is a real hassle. Reaching the Master cylinder is a real hassle just for checking fluid, reaching oil filter from the top is impossible, wires are no longer hidden as well as they were in the stock position. So some things that were simple and routine are now a bit of a pain.
