speeding ticket

coming home from work 2day on the interstate....i pass a state trooper goin 75 with my cruise control set.....he turned his lights on and pulled me over saying i was going 84 in a 70??? WHAT!....right before i passed him i set my cruise on 75 but he didnt want to hear it

WHAT DO I DO?...im surely not paying 200 bucks for a ticket that aint true.....i will take this 2 my grave...can i argue my way out of it in court? im almost definate that the pple in court will not believe me....what would you guys do?

I wouldn't try to say that your speedo said that you were going different then his radar, that will cause you an inspection ticket. They'll say you have faulty instrumentation... I've seen that before a few times... Other then that I don't really have any wisdom words for you.

only thing i would think is you shouldve asked to see the radar itself, then, if he shows you, you're either right or wrong, if he says no, then in court, his "no" answer wont look so hot.... but i'd say as is, you're sol (as sucky as that is) cause it's your word vs his...

I had a cop do the same thing. He said I was going 63 in a 45 when I was set at 50 on the CC.

It was my first ticket and I didnt know how the process worked so I pled guilty to not have the points and it ended up costing me ~ $550.

I'd go to court, plead not guilty and hope he doesnt show up. Then all you gotta do is pay the court fee. If he does show up, something will be worked out and your charges will most likely be lowered if not dropped.

either that or his radar was off because cops are suppose to get it calibrated every so often and have to document when they last did it too. I would take it to court man cause chances are he may not even show up.

Did you recalibrate your speedo to accomodate for the 3.73's and rear rims/tires? Also you should always ask to see the radar and ask to see proof that the radar was correctly calibrated.

Your only real hope is that the officer doesn't show if you intend to plead not guilty. Otherwise look into either deferred ajudication (my personal favorite) or defensive driving to keep the citation off of your record, if your state allows such.

Im just letting you know your ticket is not in vain. I got pulled over last night for squeeling the tires into second and doing 135 in a 50 zone.

The officer laughed and said 'well it sure is a nice night for it, just try not to draw too much attention to yourself'

You got a ticket so that i could get a warning when i clearly should have had my license revoked and my car impounded. I thank you.

yea i can take defensive driving....but i still have to pay for the 200 buck ticket.....but theres no way im gonna pay! thats bs....and i know my speedo is dialed in correct

Just so ya know, i've had people ask cops that. I've NEVER heard of one actually lettinng anyone see it. They either say "no you can't" or "yes, but i already erased the speed on it"

well, if they say no, you go to court, base your argument on "why wouldnt he show me the radar if he could easily prove i was speeding?" and then also to do the "why would you erase it? now you have no proof" idea

know your speedo.

don't pass a cop even 1 mph over the speed limit. he takes it as a challenge to his authority. you may do it a few times, but you will run into one that gives you a pink boy.

i have run a hundred miles an hour behind a deputy or two around here, but when he slows down i stay behind. they kind of dig that. they even wave to me when i exit.

if they run fast without lights they are also breaking the law. they can run on a call, but lights are required.

no lights... i chase. then wave.

Get a lawyer. I had a lawyer go with me to mine and I got away with 0 points and only had to pay the fine. No points on my license and no insurance points. Weee! Oh yea, lawyer fee is free. Mom's boss!

Yea if you have to pay a $200 ticket, get a lawyer and pay him $200 and it shouldn't show up on your record or ins. It's worth it IMO.
I got a ticket 2 years ago and paid a lawyer, my record is still clean.....

in most cases here in cali if you plead not guilty the officer usually doesn't show up for the erignment (sp?) because its usually out of town and causes a lot of paper work and they arn't required to for their job. Also go to the ACLU site for your rights as a speeder, it's also ur right for them to show proof of your infraction if possible. I got one for going 37 in a 25...BS so i pleaded no guilty on the means of inapproriate speed limit. after a case study (free) found at least 50% of the drivers on the road were driving at 30-35mph+ they revoked my ticket and changed the speed to 30 there, should be anyway for a two lane residential. okay...I just got a ticket last week also.
1) officers are not required(in most states) to show up for a contested hearing.
The judge/magistrate will have the officers notes on file and will use that information to help form a judgement.
2) Showing up in court with no proof of anything will not get you out of a ticket. The judge will take the officers case notes over your word period next case please.
3) Get a lawyer! You will spend a coupla hundred, but a lot of traffic lawyers will wager their fee against the fine. If they lose you don't pay.
3A) They know how to request the calibration logs for the officers radar unit and know if it hasn't been calibrated properly...case dismissed.

First of all, hoping that the cop doesn't show up for court will be in vain...All officers are "required" to show up for court or they will be disciplined with days off without pay.

Second, the officer does NOT have to show the radar to someone if they request to see it. It is the officer's discretion whether or not they wish to allow the violator to view the radar.

Third, every officer is required to check the calibration on the radar unit before they start using the unit and after they stop using the unit. They will usually document this on their copy of the citation that goes to the court. Today's modern radar equipment is very accurate. I've used the Stalker radar units when I rode motors, and they do not put out any kind of a radar signal until I pull the trigger. I get an instant reading, pull the trigger again, and I've got you. I have even stood in front of vehicles with radar detectors, hit the trigger waited a second and hit the trigger again, and the person's radar detector did not go off....WHY? The Stalker radar sends out a signal ever 1/1000 of a second...the average radar detector is capable of getting a radar signal ever 1/100 of a second...You do the math!

Just pay this ticket, remember that it's not wise to pass an officer who is working radar at a speed over the posted speed limit....If you want to contest the ticket, at least take your car to a reputable place to have the calibration on the speedo checked. Then you can attest that the 75 setting on your cruise was correct. But then again, if you admit to doing 75 in a 70, technically you have admitted to a speeding violation! It isn't whether or not you were actually speeding, it's how much you were speeding!

One more thing....you said that you had set your cruise "just before you passed him"...the Stalker radar that I mentioned earlier has an effective range of one (1) mile! So it IS possible that you were going faster than the 75 before you set your cruise control and he nabbed you before you ever did that.
