I work for Ford at the axle plant, and we make gears from start to finish. ALL of our gears are heat treated. Even if a different type of metal is used, is still SHOULD be heat treated which hardens them. All the gears we make here at Ford are made of the same type of metal, and go through the same process, reguardless of what axle size and ratio it is.
Heard it here on stangnet. A lot of people were having problem with a certain type of 3.90 gear, and there were only a few companies that made them at the time. But they had to replace them a few miles after they got them, and just...why get 3.90? go 4.10

But i wont be getting 3.90s. Just my personal thing after hearing about them.
