A very lawsuit hungry nation, indeed. We have too many rights IMO, look at all the trouble we have from people "practicing their rights".. BS if you ask me. Too bad nobody provides dumbass drivng coverage.

I was hit by a drunk lady while on a moped when I was 14, nearly died (police couldnt figure out how we lived, my cousin and I), I have some nice scars on my face from it, spent 5 days in the hopsital, took a long time to gain my stength back, my left femur broke nice and clean out of the skin. What a lucky SOB she was that I grew up in a well off family who has morals and earned what they have, that lawsuit could have been worth millions. I got $13k from unclaimed insurance money, dont know exactly how it all worked out, but I still have to wait 3 more years till I get my hands on it (thanks, mom...).

If it is a no fault accident, then her claim would be against her own insurance, not yours. Each party must deal with its own damages/claimants -at least that is my understanding (I claim no expertise). Does your above comment mean that you are off-the-hook for liability? That is your only real worry. You cannot bring justice to the system. If her insurance company wants to go after her for a fraudulent claim, that is up to them. It is a common occurance. I can make a call and verify facts for you if you need me to. I have a friend who owns an insurance company. Just articulate your questions for me and I can make the call.

I'm definitely not expert either. I'm not even sure she had insurance, that was part of the shadiness I talked about, it took a long time for her to produce an insurance card (that was for another car) and I had mine in 30 seconds, since I have one in my wallet and one in my glove box. I've never even thought about driving without my insurance card.

Basically, I was told what you just said. I am not personally liable, so whether they pay the claim is not up to me, nor is it my place to prove its fraudulent. All I know is as far as the DMV is concerned, the accident was not my fault, so I can probably go to another company and not have it count against me. It sucks paying more, but I'm guessing since they 'settled' with her, it was probably for a lot more money than i'll be paying extra for the next 10 years so I shouldn't complain too much.

Even without you being at fault, your insurance is on the rise... thats rediculous.

Somebody has got to run over that damn gecko...
