If I was you, I would just say that you chirped 2nd by accident because you are learning how to drive stick. Just a thought??:shrug: Good luck though!

I wouldn't recommend that. If you're planning on fighting it, the absolute worse thing you can do is admit guilt.......even if it is with an excuse. You've pretty much sewn up his case for him in court. Once you've admitted to it, you're pretty much sunk!
 
When I get pulled over for speeding, I always politely ask if I could see the radar gun, then usually follow it up with some sort of joking remark, so as to not come off as an ******* to the guy. Several of those times, the officer said "I didn't have you on radar, but you were clearly speeding." I got out of every single one of those tickets just by asking to see the radar gun.

I've been pulled over I don't know how many times for squealing tires, unnecessary acceleration, etc, and I've always argued my way out of it. "Sorry sir, I just replaced the clutch and its a little tight." .. "My first day driving my new car sir, not sure how to work a stick shift yet." .. "My fault sir, my wife was driving the car and had the seat all screwed up, I could barely reach the pedals!"

Not a very good defense and most everyone knows that cars with T/C have a switch to shut them off.



I was gonna say that you could say your car is an automatic and something is wrong with the trans causing it to slam into gear. The officer saw you when it slammed into 2nd causing the tires to chirp. How's the guy gonna know it was a 5-spd? The ticket doesn't say that.


But then you said he said you were fishtailing. I dunno what to say to that
 
The thing is he said he "heard me way back there" squealing tires and fishtailing. I know for a fact that I didnt fishtail. And if he "heard me" he didnt see it. Know what Im saying? He pulled me over as I was pulling into my apartment complex about a block or so ahead of where i chirped my tires. Im betting that he heard my car and had to catch up to me to pull me over. I didnt spin out or fishtail. He just heard a loud ass car but I honestly did chirp 2nd. Itll be up to the judge to decide. Ill get a lawyer. That itself almost always reduces the ticket immediately.

Well how would asking to see the radar get you off speeding what if he says no or jst says i turned it off them what should some one say?
 
do anything and everything you can to get out of the ticket. Get a criminal defense lawyer.

Trust me! I have a reckless on my record because I just went with a public defender. I had to pay 1000 in fines, defensive driving school, lost my license for 30 days, 2 year probation, SR22 high risk insurance for 3 years. Basically I'm screwed. I would hate to see that happen to anyone else!!!!!

Don't bother with the excuses, just stick to the facts. The fact is, is that he heard you and didn't see you. If you can prove he’s lying about seeing you and getting you on radar, the rest of his testimony is open to criticism and you're well on your way to winning the case. Coming up with a bunch of half assed excuses only leaves more holes in your defense. Keep it simple and don’t admit anything!
 
I dunno where youre From but I'm from IL and that can be wreckless driving. The offense would be 625 ILCS 5/11-503-a-1.

(625 ILCS 5/11‑503) (from Ch. 95 1/2, par. 11‑503)
Sec. 11‑503. Reckless driving; aggravated reckless driving.
(a) A person commits reckless driving if he or she:
(1) drives any vehicle with a willful or wanton

disregard for the safety of persons or property; or
(2) knowingly drives a vehicle and uses an incline in

a roadway, such as a railroad crossing, bridge approach, or hill, to cause the vehicle to become airborne.
(b) Every person convicted of reckless driving shall be guilty of a Class A misdemeanor, except as provided under subsection (c) of this Section.
(c) Every person convicted of committing a violation of subsection (a) shall be guilty of aggravated reckless driving if the violation results in great bodily harm or permanent disability or disfigurement to another. Aggravated reckless driving is a Class 4 felony.
