Paint chip - who is responsible?

When I was washing my car, I noticed there was a paint chip on the bottom corner of the factory spoiler. I also noticed that there is a spot on the car directly below the spoiler that had touch-up paint applied. This spot is practically invisible (especially since it's under the spoiler), but it's there. To give you an idea of the paint chip, it is a the very end of the spoiler in a triangular shape where the spoiler has it's "pointed" edge. Picture the part of the spoiler that is closest to the decklid. The chip is about 1/2 inch in size.

It seems as if the part that was touched up was hit by the spoiler during installation.

In any event, I went to my local Ford dealer (I did not purchase from a local dealer). The service rep said that I had to contact the dealership that sold me the car. I told him that I thought warranty issues can be covered at and Ford-Lincoln-Mercury dealer. He agreed but said that "this is a dealer issue, not a warranty issue." So I called and the salesman indicated that the car would have to be looked at by their service manager. I asked if there was a way that my local dealership could look at the car, make a determination, and report back to the selling dealership's service manager. The salesman (who was very helpful) said he'd see what he could do. I went up the chain of command and the ultimate decision was that the selling dealership would have to look at it.

I can't afford to take a whole day off from work just to have someone look at my car. Then who knows if I have to take it back another day for the actual repair.

I'm really stuck. Is there a Ford Service Center I can call to have this taken care of? Or, does anyone have any other suggestions? Any help would be greatly appreciated.

One vote for aftermarket spoiler!

I've got the same situation my selling dealer is clear across the state.

Vandil - that's what I was thinking. Any tips on a good ducktail that will cover the factory spoiler holes? I like the CDC spoiler but I really think the add-ons to cover the factory holes are ugly
