Smog legal gears? What the...

A few days ago I ordered a set of FMS 3.73's from DPM. But after I ordered the gears, I noticed this in the product description:

"Not legal for sale or use on pollution-controlled motor vehicles."

How could gears not be legal for use on pollution controlled vehicles? They have nothing to do with smog. The part # for the gears is 4209-F373N, so it's the same part number as summit and all the other FMS distributors. Does anyone know what this is about? Here's the link:

Technically they do impact smog and fuel mileage. Higher revs burns more gas and makes more bad exhaust gases. Both impacting smog.

They're just covering their ass against lawsuits.

The same caveat came with my King Cobra Clutch. Even if gears "technically" impact smog due to increased fuel consumption, I must be missing the connection a clutch and pressure plate have to smog issues, although I'm sure someone can make an argument.

3.73's not being smog legal, well they come stock on exploreres and F-150's.

i bought a phenloic spacer from FMS and there is a sticker on it says the same thing about emissions

Hi-Po parts aren't tested to be OE replacment and are different in design and therefor don't get the "legal for road use" tag. Hi-Po parts also have no warrenty - implied or expressed.

They are smog legal on those vehicles, but not technically in Mustangs.

It's all about the sharks...er I mean lawyers. It's nothing more than businesses doing what they can to protect themselves from lawsuits.

Change your gears, run your phenolic spacers. It's all you and you can't go back on the manufacturer of said part when/if you get into trouble with it. That's all it's about.

Ever hear of a guy getting ticketed for having 3.73 gears in his car? No.

tjm nailed it - their lawyers want that disclaimer on everything to help cover their - well, you get the picture. That way if some techie havin' a bad day busts you because of the high revs he sees on the rollers/sniffer test, you can't say it's Ford Racing's fault.

So technically 3.73's are not legal for pollution controlled vehicles, but they won't give me any trouble passing emissions, will they? I know 80% of you guys on this site have gears and pass smog just fine. I gotta pass CA smog comin up here in March. Yikes. I think my bigger worry will be my catted x-pipe, but hopefully that will pass just fine too.

OT: instead of just putting on an off road pipe then waiting when your smog/registration comes up....cant you just smog the car before you put on the "non-smog equipment" so you have a valid smog check on your dmv papers so you can just reg the car? you can smog the car whenever you want before its required cant you?

i justpassed ca smog a week ago in my 373 geared 86gt. you won't have a problem.

I'm sure it's on all of their receipts. Summit is that way also. No matter what I have purchased, all receipts from there say it. Like when I bought some gaskets...no one knows, or is even going to care. It's just stated so that you can't point a finger at them when you fail smog...
