Am I screw ???

I used Paypal to send a good sum of money for a supercharger posted on the other sites. The seller did not respond to my email since Oct 3 about tracking number etc,payment was collected on Oct 1.
I understand Paypal have a 45 days window for the buyer to open up a case. But it seems to me reading over the terms is that they will only trying to get my money back if the seller have funds available in his account. So if the seller closed his/her account and moved to Greenland etc, then I am out of luck. I am no lawyer . But is that what it really mean ?

Any comment or suggestion is welcome.

How did you send the money? Visa? MasterCard? I believe they will help you out if you can get ahold of anyone. I'd try to locate the seller first, I had some deals seem to go bad, but they all went through without a problem. Sorry to hear about your problems though......

I used a Master Card debit card so maybe if all else fails...

Update ~ Received a email from the seller after I inform him that I will take it up with Paypal,he wrote that he was in a car wreck and the blower was in the car at the time and only just able to get the car back. And that he will ship the box Friday afternoon or Saturday and send the tracking number. I will wait and see if that is so.

Guess I will deal only with larger company for big ticket items and buy parts locally.
I deal with lots of peoples here on the NW forum over the years behind the scene and this really is like someone pouring cold water on my head. lol

So he sold you a S/C he was still using? Most people sell parts from a parked car or remove them first. Seems fishy right there. Second. He couldn't send that email sooner, was his computer in the car too? I could just be a sceptic but I'm not sure you're ever going to get your parts or your money back.

always pay for everything on paypal with you credit card, NEVER with your bank account. IF you don't recieve something you payed for or it is defective you can just cancel your CC transaction and it is very simple, if paypal pulled it out of your bank accound; good fricking luck you are screwed.

I just had to do this recently...

one last thing becareful about what bank accout you have attached to your paypal account, sometimes they will try to sieze money out of your bank account after you cancel you CC transaction. I recomend having a special bank account just for pay pal and only keep a buck or two in there...

To clear up matter the Supercharger was already packed and was in the car that was wrecked..Won't do me any good if it is all a lie. :(

Open a case with Paypal this morning.
 
Update~ The seller send me a email today giving me the tracking number for the supercharger he is shipping out by UPS. ( I check and there is a box sitting there ready for shipping ). Just hope it is not a box of scrap metal or worse ( Like a extra washer floating around inside the housing ).
He asked me to drop the case against him or he will be force to take action to defend himself. I told him I just wanted to go on record with Paypal and will drop the case only after I received the blower.
It is odd that he did not used the Paypal site to returned my email but email me directly.
