That's bull-crap dude. Certainly looks like he was asking for Mustang parts. Not to self...don't do business with N8Miller.

Post the entire email and let's see everything.

fock you! that IS the entire email! i told him i had a rear, but wasnt sure what it was from..... he knows that.

I thought that he was just using any rear for his 7.5 to 8.8 conversion and i apoligized for the misunderstanding, offered to help install the rear, give him my discount at the auto parts store i work at, cheap prices on his slicks and other things. why doesnt he go high performance and get an auburn diff if hes going to use it under a worked 351?

I'll make no appoligies.

He said you knew what he had and it's within reason to believe you knew what he wanted the parts for. To me, you seized an opertunity to scarf some cash on that rear end. That's all. As for the other stuff. Helping install a rear end (that's not out of a Mustang??) and getting him a price break on the tires....that's not what I think is bad business.

Claim what you want, but I saw it on the window sticker and I drove it and it was not a traction-lok. I remember quite clearly because I was shocked it was not a traction-lok car. It was a 2.73 open diff car. It was brand new on the dealers sales lot. I know what I saw and I know what I drove.

I can't argue with what you saw and drove, except to say that any documentation you find will show the Trac-Lok as standard equipment. If you can find otherwise, I'll certainly eat my words -- but for now, I stand by what I said.

---------------

As for the original situation -- I can't help but say I'm not aware of any 8.8's that were the same dimensions as the fox rear but without a trac-lok, so I suspect it's either been changed or it's not going to be a direct fit and be right. Regardless, I could see where both parties come from, though I would think if you were concerned with what was inside the rear, you'd specifically ask for that info (along with having it fit the car) -- and if you were selling the rear, you would specifically state what was in it or that "you didn't know" (along with what it was out of). But, that's my opinion, which doesn't really mean much.

Interesting thread, so I'm subscribing.

I'm not taking sides, sooo

--seller: if the seller knows anything about mustangs, he would clearly know that this is NOT a mustang rear end, and does not have traction lock. IMO, an honest seller would go further than to say I don't know what its from, you should have stated I don't know what it's from, but it's obvious it's not a mustang rear end, it doesn't have trac loc, it doesn't have quad shock mounts, but it WILL fit your mustang.

--buyer: it is clearly your responsibility to FULLY research any used part you may buy. Unfortunatly, if you don't do your homework, and know what you're looking for, or at least inspect the goods before delivery and payment, you're kinda out, as there are no gaurantees in the used parts world, and the seller may have had no clue what he was selling.

just my .02 hopefully the two of you can work this out peacefully.

Nate, in all fairness, you didn't show the other email I sent you before that one. Remember, it said I would offer $125 for that rear only because I didn't know the condition of the trac-loc ....remember that one.
Key word there is TRAC-LOC
I'll admit part of this is my fault because I should have checked this all out before it was unloaded from your car....buyer beware....right?
I just remembered that prior email I sent you and that's why I'm bringing it up now since you are quoting my emails.
If I was made of money I wouldn't stop at an auburn diiff, I would go right for the spools and I wouldn't be upset that I might be out some cash.

Yup, every V8 Mustang from '86 and up with an 8.8 rear has had the Trac-lok. It's not an option, it's standard.

There were open-rear 8.8's, but none ever in a Mustang

It was verified that it was, in fact, a 7.5 rearend and not an 8.8 rearend.
Nate has agreed to refund my money and that it was an honest mistake.
Everyone's happy again.

351 82GT is trying to screw me now!

Brian Lutz- 351 82GT -advertised a gt40 intake for sale in the For Sale section. When he sent me a photo it was of a Cobra intake. I sent him the money for the Cobra intake, and he shipped me a STOCK EFI INTAKE. Now he will not return my calls and sent me an email pretending to be his UNCLE stating Brian was sent to "Germany with his special Army unit".
Stop trying to hide and do the right thing! Refund my money! You are being dishonest and we don't need people like you on StangNet! You thought dude was trying to hose you over on the rearend and you TURN AROUND AND TRY TO CHEAT ME!!!!!

Yeah, I would like to get it worked out. He will not return my calls or emails. He is blatantly trying to cheat me. It appears that he never had any intention of sending me what he advertised!

Gotta add a bit of stuff here.

They buyer absolutely must know what he or she is looking for and looking at.

The seller is not obligated to explain the details of what is being sold. This is very different from misrepresenting what is being sold. An "8.8 Ford rear axle" may or may not be a posi, or the gear ratio you want. A truck guy may need 31 spline stuff and has no use for quad shocks. I see this all the time in general classifieds. Ranger truck guys love 7.5 in posis! If the seller states positively an incorrect fact, the seller is at fault. Most sellers will be non committal enough to avoid that.

The buyer should be prepared to ask the questions that will confirm the item is what he wants. If the answers do not confirm it, or if the buyer is not satisfied, the buyer should move on.

Examples:

I bought my 8.8 at a Fun Ford Weekend. It was just what the seller said it was, a Mustang 8.8 with quad shocks, ebrake cables, 28 spline axles and a 273 posi. It really did not matter, it was well priced, $150 or so. But I checked the tag on housing, which confirmed it.

I will change the gears, the axles, and the differential before too long, to 31 spline, c clip eliminator, spool setup. I wanted a housing cheap, and the stock guts did not matter.

Another:

I bought a running v8 donor car from a bunch that swore it was a 5.0. I knew it was a 255, but it was still cheap, and I got what I wanted, all the v8 conversion stuff. If I had not known, and needed the engine, I would have been screwed.

Last one, and my funniest experience:

On the other hand, I bought a small block Ford intake from some guys girlfriend for $35 once. She and I both thought it was a fair deal. The guy freaked, and tried to have security get it back. They explained that it was for sale, I paid what was asked, and if he did not like it, he would be helped to leave. I only wanted a 4 v intake, not a rare old showpiece, so I got my money back, and gave him his $150 used Edelbrock back. I think he still hates me.
