Good luck getting a lawyer to take your case. If it was a man with a convicted record who had a history of comitting sexual offenses it would have been totally different. I've studied cases like this and as long as the store can prove that the lady's intent was merely to check if the boys stole anything you are pretty much out of luck. I'm probably going to get flamed for this but personally, I don't have any sympathy for people who sue frivolously. Our court system is already flooded with too many bugus cases in which the plaintiffs only interest is making money.

So I ask you this: Using your own common sense and fair judgement, what did you believe the lady's intention was ? Was it sexual or was it to simply to check if they stole anything. Did the boy's experience any "emotional damages" after this incident happened (keep in mind that this is not rape). If I were you I would try to answer these questions before taking any sort of legal action.

Actually my son was crying half the night over this. He is really shy. She didnt even take him into the dressing room. She made them drop their shorts right there. I found out more to the story too. Once she didn't find anything in their shorts. Instead of giving the shorts back and apologizing. She threw their shorts in the trash. A woman who was shopping went over to try to stop her from strip searching the boys in the middle of the store. But she started getting irrate and told her to mind her business. It's not the point of was their any sexual intent behind it. It's a matter of violating a child civil right? I have a friend who is a corporate lawyer. And right now he said the woman is facing at least five charges all of which are felonies. Add to that there were two witnesses(the one lady who then called another lady over to witness the event). Both of which gave their phone numbers and said they were willing to testify if need be. And you have a strong case no lawyer in his right mind will turn down. As a matter of fact the store itself I'm pretty sure will want to avoid public humiliation. And just settle. But it's not about money. This is about making this business responsible for the actions of the people they hire. And for their managers to make better decisions when handling incidents like this. NO CHILD, deserves to be strip searched like this. I don't care what they were doing. Children cant defend themselves so it's up to us as adults. To make sure if something like this happens. It never happens to another child again. And trust me it won't after I get done.
