I called the cops on a guy last night for something like this. To keep the details short, I drove by his house and everything was cool but I heard someone yelling so I roll my window down and slow down. I look in my mirror and the dude's cussing me. Well, I figured he was having a domestic with his g/f who was in a car he kept lunging into so I reported it.

The cop called me later and told me to meet him at the station. He just wanted to know what was going on because the dispatcher screwed it up and turns out they were arguing and she had a red mark across her chest. She said it was from a necklace she was playing with blah blah blah. He's 18 years old and the cops are LOOKING for something to nail this guy on. Just one bad apple they say.


On another note, my co-worker decided to defend HIS g/f at a concert when they just verbally assaulted her. He wound up with 2 broken vertebrae and has to wear a neck brace for AT LEAST the next 2 months.

On topic though, props for stickin up for the girl when you knew her boyfriend wouldn't.

How can it be self-defense? HE wasn't the victim, SHE (friend's GF) was.

If she had hit that guy over the head with a bottle (for instance), then she would be somewhat justified in defending HERSELF.

If the guy had punched Sunburst, or the guy took a swing at him and missed, then yes that's self-defense too.

Sunburst took it upon himself to assault the guy when he technically isn't involved in the first place.

Another person's "honor" is one thing guys, but we aren't living in the 18th century anymore the last time I checked.

no, but you do not have to be directly threatened to legally and rightfully defend someone else. If you see person A push/punch/kick/ etc. person B, you (person....C?) can intervene. Now, punching him when hes down and out is just plain battery.

Really, its one of the few things I learned this semester about torts and ****.

I also had to throw down with my gf's former step-dad about 2 months ago. Goold ole Billy (super redneck if there ever was one) thought it would be nice to swing by uninvited and push her mother around while I was watching. His throat met my fist and his head met the rear view mirror of her mothers VW bug. Once he was down I just held him down and didnt keep beating on him, (although he probably deserved it; he was kicking like a little girl) and thats what kept me out of any legal consequences.

Yankee stuck in the south 1, redneck 0.

You can intervene, but you are still committing assault. Whether you get prosecuted or not is another story.

I gotta agree, you do have the legal right to defend another if they are not capable of defending themselves. While you could be charged with assault, I think self-defense would be a good defense except for the fact that a beating continued to occur. Now it would have had to have stopped once the threat of continued harm was over. Its all up to the police at the time if they feel like charging you or not.

There was a recent case in OH where a man shot and killed a teenage boy while the boy was stealing his car. Was no threat to the man, the boy stole it from the driveway, the man was inside....the man came out with the gun and started shooting. DA ruled it self defense because in OH you can use deadly force to protect your property as well. So it depends on which state you live in too.

You debate like you don't see a problem with someone pushing a girl for no reason than he was probably just pissed because she hurt his pride or something. Has this ever happened to you? I gotta say, anyone ever laid a finger on my wife or my mother or something, I'd beat the stew out of them. It has nothing to do with honor, it has to do with taking care of the one's you love and care about. It may not be right to continue it beyond stopping the problem, but I'd damn well make sure the person never thought to do it again to anyone else. And anyways, assault is the charge, self defense would be your defense. It can be both ya know.

I think it was good you stood up for this girl when no one else would, but you should have stopped once the threat was neutralized.

Assult is just putting up your fist and making it clear that you are about to kick ass. Battery is the act of punching the person or comitting injury.

And you have a legally recognized defense, called "Defense of Others". If you stop once the threat is subdued, theres not a judge in the land thats gonna find against you.

Im just curious as to what your issue is against someone throwing a fist or two to protect another? Id sure as hell hope you would shake the hand of a guy that stood up for your spouse if you werent around and some ******* tried pushing her around.

Throwing a haymaker to protect someone may technically be considered battery, but its the same principle as cops driving 95 in a 60 trying to get to an accident; technically illegal, but legally justifed.

You have to remember, the guy pushed the girl--he didn't hit her. Was she injured from the push? I doubt it.

In Hawaii, that would be Harassment, not Assault. Here, he wouldn't be justified in punching the guy who pushed her. Now again, would it go to court for prosecution....probably not.

Many people misunderstand the differences between assault and battery. Like four six said, no physical contact has to occur for assault to occur. Simpy creating apprehension or fear in another can be considered assault. Completeing that act with physical contact is battery. Battery does not have to be harmful, it can just be offensive. Pushing someone is Assault and Battery, not harrasment. (well, im sure harrassment would fall somewhere in there)

Im willing to bet the vast majority of us have committed assault and battery at one time of another and neither us nor the victim had the slightest clue.

Well, every state has their differences in statutes. I don't know the laws where you guys live, but they sure are weird.

In Hawaii,
1. Punching someone and causing bodily injury/pain is assault.

2. Lifting your fist and making a gesture to punch someone can either be Terroristic Threatening (if they feel threatened and the suspect threatens bodily injury) or Harassment.

If you were a black belt it'd be assault with a deadly weapon! Oh snap...either way I don't think we're arguing with San over the right thing. I think what he's saying is that no matter what, it's assault...and we're saying we don't care because it was deserved assault. Kinda like if someone has a gun/knife to your wives throat and you shoot him in the face it's technically murder but you probably won't get in too much trouble for it.

Society has become so ****ing soft and any issue that is discussed always ends up with people talking about article _ section_ of blah blah blah ...

Forget the "laws" for a moment. It is wrong for a man to push or hit a woman .. ESPECIALLY one that he does not know. What I mean by that is if you and your girl get into an argument and she gets all up in your face, slaps you or something, then IMO you have the right to push her back away from you (NOT HIT!) .. However if you are a drunk man at a club and you just push around some girl for no reason then you deserve to be put in check.

I guess instead of standing up for his friends' girl he should have pulled out a Bible and started praying for this guys poor soul.

How about pushing that guy away from the girl first, rather than punching him first? That's still "defending" her, but doing it in a way which technically isn't breaking any laws. Had the guy been pushed away, then charged/attempted/ or w/e to try to punch Sunburst, then he would be more justified in punching him to defend himself.

Do you think he would have acted the same had he not been drunk?

I agree that punching him in the face wasn't the best solution. lol.

I was just trying to say that there isn't much of a justification for pushing a girl, while drunk, at a club ..
