I would say shaft seal,but did you install your tri ax,I ask because when I installed mine a week or so ago,I used a silicon type stuff to seal between the shifter and tranny,but for some reason there was a spot that didnt seal properly and after a day or 2 of driving I was seeing a small amount of trans fluid on ground,and when i looked under to see what was up,it looked as if I had fluid leaking from the front and the rear of the tranny,I was about to be lit up thinking the tranny was crap on less than a month old car to me,But I thought i would pull the shifter to check it out and I could see where it was leaking at,more silicon and its fixed.Just a thought.
I have no idea,I drained the fluid,to see how much it had,which was 3.5 quarts.When I resealed the shifter not a problem since...so i dunno how it was happening,it didnt seem to be much in the shifter area.Im not a tranny person and dont know much about them other than the main key parts....never even seen the inside of these trannies.
I don't see how it would be leaking up there. There is no pump in that 5-speed. The gears are simply immersed in oil to the level determined by the fill plug. You might try draining the fluid, making sure the car is level, and then filling until it runs out the fill opening. I hate pumping fluid in so I pour it in from the top thru the shifter linkage opening. Let it sit until the fluid level settles down, then bolt everything back up.
As far as leaking around the shifter, how is fluid getting up in there to fill that area up so that it will leak? If the tranny is overfilled it will certainly leak as when it gets warm, fluid will be forced out. But filled properly, leaking is not common, and is actually quite difficult to make happen. The rear seal usually will only leak if you park pointing up a pretty steep driveway or hill. There's no fluid being pumped around inside that has to be contained by a seal...
BTW, the reason for the silicone around the shifter is not to keep fluid in, it is to keep water _out_...
3.5 quarts sounds high. Which might be your problem. Proper fill level is so it just runs out the fill plug hole. Any more and it is going to work its way out somewhere...

good observation lol, my bad i didnt mention it, i thought it was clear from sig...
i dont park on any hills, and i used a fair amount of rtv when i installed the shifter. im taking the car down to ford tomorrow, and if they dont find a problem its going to a different dealer. thanks for the help guys.
