What a day... :( poor mustang

This is just like last summer when this dumbass pulled out in front of me in my Bronco II and i destroyed it. I was selling it to buy my Merkur, but it was an awesome truck and even though i was selling it and even though i'm happier with the Merkur, it really sucked to see it totalled.

My neck was really stiff the next day, my whole body was sore. I don't think i was hurt, it was more that i just got so tense that it actually strained muscles. I T-boned a van going 45mph...i hit the brakes but only had about 10 feet to slow down and they locked up, and at 45mph 10 feet is useless.

thats exactly what i did...i was going 30 though brakes locked up and i hit her at maybe 25-20. and tensed up and braced for the hit...im sore...my buddys fine..( he was texting ) and the bitch in the van...she went to the ER. saying she couldnt move :notnice:
 
Ouch! that sucks, Now, as far as her insurance company dont lose your cool when you talk to them... If they try to spin things on you let them know that the facts are clearly stated in the police report and that their client is at fault not you, and if they keep trying to spin it on tell them that you just want to be paid for the damage caused to your car by their insured customer and that if they keep insisting on blaming you even though the report police states it was the other parties fault you will be forced to get a lawyer! once you threaten lawyer and the fact that it will cost them more if you get legal representation they will change their tune
 
Rule #1 in an accident. Talk only to cops and request an ambulance.

Rule #2 get X-Rays of any and all areas which hurt

Rule #3 call your insurance and tell them to fight on your behalf, so you dont have "rosey sue" calling from the other parties insurance asking you "why you were born".


Personally if my neck was hurting and it was within 48 hours I would still go to the E.R. and get x-rays .. you can fracture and chip bones a lot easier than you can imagine.

edit: what's worse is that we're both young and i'm sure if you're working that you're not making much more than i am.. after all the dough i've put in my notchback, if it got ****ed like that, i'd cry.. like, straight up cry. and living in New Jersey, coming in contact with ass hole drivers occurs on a daily basis. 4 banger insurance is great, by the way. i vote that you do that.

Ryan sorry to hear about the car and glad to hear you are ok, I read in an earlier post someone say that you will look back at this and laugh... I dont know about that I was tboned in my 89 gt about 15 years ago by a girl blowing a stop sign, she hit the rear wheel and quarter panel and just destroyed the car. The good news it lead me to having a 93 notch as my next car but I am still pissed that my first fox was destroyed.

On a lighter note is it just me that noticed that since Ryan hit his head his spelling is better? :D
 
Ryan, sorry to hear about your misfortune. My first truck was taken away from me when a 73 yr old woman rear eneded me. I have a permanent forehead scar and still hurt in my back. I did get a lawyer that took a percentage and it still wasn't enough for the pain i still have. Get checked out, her insurance will have to pay for it, then don't settle for less. Lots of lawyers out there work for a percentage of what you get. It will be more than what you would get on your own. I am not advocating trying to rip off the insurance, just getting what is due to you for pain, suffering and all your work gone down the drain in seconds. Good Luck:)
 
DONT EVER Talk to the other parties insurance. it is being recorded and can be used if a lawsuit comes about. if what you are saying is true I definitely see one coming. the other party has access to the police statement and it has all the relevant info they need. if they call you at the house refer them to your insurance company or a lawyer. they always try to call you right after the accident so they can try and trip you up while you are still pissed or confused. I have seen this happen to several people. listen to your parents and what other older individuals are telling you. this has a chance to get messy quick and even though you werent at fault the fact that you are sixteen is going to play against you in the eyes of the insurance world.
 
stykthyn is not kidding. They will record you. Now, they should tell you in advance. At least they did with me. I told them exactly what I told the officers at the scene.

Best advice, do not say anything until the other party's insurance company has the police report. I'll say it again, I am really surprised they called before the police report was available. Even my own insurance company would not commit to anything until the report was released.

Remember this, as long as that report sides with you...you are the person at loss. This incident will not be you financial responsibility. You are due compensation for her poor driving/decision making. Whether that is considering your car a total loss or having it repaired is yet to be seen.

If, when the adjuster comes to look at your car. Have a total and copies of your receipts available.

Also, do you know if the state you live in (Ohio I think) decides fault for accidents?

If your neck is already stiff right now, it's only going to feel worse tomorrow. GET IT CHECKED OUT BY A DOCTOR, ASAP! ... and then send her insurance company the bill. Don't look at it as trying to squeeze someone else for money by going, "Oh, whiplash! Oh, I'm sooooo hurt!" but rather, consider the fact that not all injuries' severity will surface until awhile later. It'd suck to play it off as being nothing right now, and then find out later that it's something way more serious that you should've had treated earlier ... and something for which the responsible party's insurance should have picked up the tab.

Also, not all injuries get better on their own. Your neck may be stiff now, but if you don't get it looked at/taken care of right now, what if that stiffness doesn't go away? What if it gets worse? DO NOT SETTLE WITH THE OTHER PARTY'S INSURANCE COMPANY YET. Again, get yourself checked out. Go to an Urgent Care Center or ER, NOW. Do it.

my parents have been cool about it becasue 1 this was 100% not my fault. and they can tell how down i am becase of it and they know im not in the modd for anyones **** right now. I did everything i could to aviod her...there was a car on the left and a car on the right. then her in front of me. we all know fox body brakes are not the best.

my dad really dont care what i do. he said if i want to buy another mustang then thats fine. he is the one that suggested swapping drivetrains into a clean roller. this morning my neck is worse. :( it cracks ever time i move it. this suckkkkks
 
Ryan...I'm sorry for the inconveinince, but that is NOTHING. A fender, bumper cover and a new 6pc light kit from 50 resto, and your back on the road. The apron that is tweaked.....big deal....dolly it back around, line up the body parts and paint it this spring like you said you were gonna do.

Not that anybody here said it can't be fixed, or it ain't gonna be right ever again.....but there are always people in your world that will say that....don't listen to them. It's just nuts and bolts....get er doooonnnnnnee!!!

I'm with him. this thing is faaaaar from totalled, and you being 16 what is totalled to you, to the insurance company it's a certian % of the vehicles value, your estiimate included parts and labor. to us totaled is tweaked, bent. you have no damage to the strut towers back, the car isn't bent or tweaked. The way I see it you have 2 options after you unbolt everything and get ready to do what car guys do get dirty and salvage that thing..

option 1 .

after you pull it apart(including radiator) start banging out the core support and apron, next dry fit the parts until they line, you will need to bang them a little past so they will spring back to where you want it(hard to explain but you will see it happen), bolt her up. the glass is easy. I replace my worn pitted windshiled at a glasshop for around 3 bills with a new one. used even cheaper. the pulling just could be bent tie rod or other hard parts.

option 2

same as above strip her down, but buy a core support (50 resto) haul her to shop have them straighten out the apron, weld in the core support and do some pulling if needed, you bolt her back up.

either way it will come way cheaper in the end than doing a 4cyl swap. she will give you years worth of enjoyment and you can sell her later for another stang. it wil come out cheaper in the end. this car is not worth scrapping and will have resale value.

just give yourself some time to heal up and think about it.The others gave you great advice on what not do with the other insurance company. i wish you the best
