Hey Gang---

Well you heard right...the apartment complex gate failed to stay open and scratched the piss out of my car The right hand side (two sliding parts that come together when closed) was already malfunctioning and off the track so it was inoperable. While going through the left hand gate which opened and then closed right on my car and left 2 nice deep scratches. The apartment complex says sorry we are not responsbile. Anyone have any suggestions or know of any recourse? I have pictures that show the gate was f'ed up on the right hand side, damage pictures of my car and the sign that says protects them. Can a sign like this really cover their ass? Seems to me it would be like me putting up a sign that I am not going to pay next months rent...doesn't mean $hit.

Aaaahhh I feel a bit better. Any idea how much its going to cost to sand/repaint my drivers side door? Any suggestions where to go?

Nope. Just like those signs at the dealership that say "we're not responsible" is

Talk to your insurance company. They have lawyers that will go to bat for you.

Thanks for the advice, I was hoping to keep my insurance company out of this entirely. At my age (24) with my car I believe they would drop me or raise my rates through the roof. If worse comes to worse I guess this is small claims material. So the sign really wouldn't hold up in court? The exact verbiage is "Caution--One vehicle at a time--Management not responisble for damage"

Were you trying to force 2 vehicles at a time? Nope. That's what the sign means. I was suggesting insurance to get a lawyer on your side. All you should have to tell the complex is that you're gonna get your insurance company's lawyer. That means you pay nothing and the lawyer cares if you win. They will maybe get scared and pay.
