HELP!!!! Warranty help!!!!

Anyone that can help...Please help.


Two nights ago I was driving home from work and my tranny started to make a bit of noise in second gear. I gave it a little gas to investigate...then CRUNCH!!! Second gear is gone!!!! The tranny is making so much noise I cant even hear myself think. The car still drove fine in each gear but second.

My problem is this; The car is at the Ford dealer right now. Second gear is totaly rounded off. The car was bought with a few mods done to the car. I did not know about what was in it. The warranty company is coming out to inspect the car in the morning. They will see that the car has a Centerforce clutch. This would be a moddification to the powertrain right? I am being told by the dealership that the warranty company will not honnor the warranty due to the aftermarket clutch. I need to know if it is possible for them to do that. And if so can I try to get the money back for purchasing the warranty that doesnt help me? Also All of the mods where don before I bought the car. The warranty was added to the car at the time I purchaced the car.

Tell them exactly what you said... You bought the car in good faith and have no clue as to what's been done to it. Tell them you drive it like a virgin under the sheets and if this warranty cant apply you want a pro-rated amount back from them from the time the initial owner made such modifications.

Sure they'll say no. But tell them that you'll be glad to do the best you can to hunt him/her down.

No matter what, don't let them know that you made any mods, or were aware of any, until the mechanic told you. And tell them that your girlfriend/wife is affiliated with the media... and will assist them by presenting a story to the paper, tv, radio NEWS EDITOR about the bad car purchases and pre-existing warranties with (such and such warraties Inc.).

I personally would find it hard to beleive the warranty company would give you a hard time about the clutch that is installed. Since clutches are a wear item, there is nothing in your warranty (most likely) that says you must replace a worn out clutch with an OEM product. This is probably one of the few places that the Magnuson-Moss Act does have relevance.

The other thing, the warranty company accepted the contract to warranty your vehicle, and I am sure it was sold as-is, and if the parts were on there, then they probably have to live with it. This does not mean if they warranty the clutch, they need to replace it with a centerforce.

This is like UPS accepting packages with insurance, amd many times these packages were damaged in transit and they refused to pay do to what they considered inadequate packing. Guess what, they lost a class acion suit. This is not to say they keep trying to slight their obligations though.

If they do deny warranty work, always be polite, but don't take no for an answer.
