if my current intake w. EGR spacer will bolt on to this fine, i will probably go with this.

That's a Ford explorer intake without the EGR passage. It will work, but you are deleting the EGR.

I'd keep looking. The 96-97 (with the internal EGR) ones pop up for sale if you are patient. I'd even check local classifieds or FB groups for one for sale. Like I said before, going rate for "local" sales of explorer intakes is about $100 for the upper/lower plus usually the TB.

noob question, but what is the functionality of the EGR?

Which year of the explorer is best for a 90 GT? I have the GT-40 lower intake already.

They are all the same other than the provision for the EGR in the upper. I'd seek out one of those as they also have beefier mounting flanges where it bolts to the lower
What is the benefit to keeping EGR/ deleting EGR? all i know is it has to do with recirculating exhaust through the engine somehow.

The price of genuine cobra intakes is going up, but $650 is too much. I've seen them complete upper+lower for $300-400.

But, unless you have a thing for the look of the cobra intake, the explorer intake is pretty much the same thing....for way cheaper

Improved fuel economy at cruise, lower cylinder combustion temps. Really no benefit in deleting it. Most people delete it when their engine combo uses parts that don't have the provisions for it, like radical cylinder heads and intake.

Exhaust Gas Recirculation is used to displace some of the air (and therefore oxygen) in the intake charge to reduce the amount of fuel used during part throttle cruise. The factory tune is expecting it.
