My buddy backed over my other buddies Camaro rlaugh: ) it was an accident, well, the buddy that done the damage told him to get an estimate and he'd pay for it. The estimate was 1,1xx (dented hood, busted front bumper). They set it up where he could make payments, and when all the money was there he could get it fixed..well the guy sold the Camaro (89 Z) and bought a 95 Z, well the guy that tore up the other car said "so this means I dont have to pay anymore, right?"..turns out the guy STILL wants the money to paint his new car.

I think this is complete .

Even if he sold the car, the other guy should still pay. The car was worth more before the damage than it was after the damage.

He did $1,100 worth of damage.....he needs to pay it all back....who cares if he still has the car or not...

He did the damage, now tell him to man up.

The guy with the original Z28 shold have never sold his car in it's condition. He should have collected the money and fixed it, like they agreed to do. If the guy in the truck was willing to pay the damages, any loss the Z28 owner received from selling his car (While still messed up) is his own fault (Z28 owner's fault). I wouldn't pay any more than the $400 that's already been paid.

If the guy in the truck was paying him back, why would the Camaro owner sell prematurely and recieve less for the car? The truck driver is at fault, but he' not at anyone's mercy. Just because he damaged one car doesn't mean the Camaro owner can take advantage of the situation.

I think he should pay. If someone hit my car(which they did) and I was given 1500 bucks for the damage and I put it towards a blower so be it, my car was lessened in value from the damage caused.

Yeah, but you still put the money towards the car that was damaged. This guy is wanting to put it towards another car.

doesnt matter, if you do 1100 in damage, you pay 1100. he cut the guy a break by letting him make payments an not have to make a claim on his insurance an get a higher rate.

so what? The damage was done and whether or not he put it towards the same car is irrelevant. Let me put it this way.

The same thing happens to you, you get hit by the truck guy. You agree to have him make payments, but only 400 bucks into the payments your car gets tboned and totalled out. Does that make him any less responsible for the damages he caused?? Hell no!

I used a bad example before. I didn't have to put that money towards fixing the car at all. I could have taken it and driven a damaged car with the money to pay for the damage, but used the money towards, say a new laptop. Who gives a ****? He damaged my car and no matter what I am getting compensated for the damage caused.

Ehh I assumed it was a truck, sorry for that if it wasnt. But the money he is paying is for the damage done, not good the guy wants on a new car. I don't know, if he was a "buddy" I would have used the money to fix the car, not to help my next car get whatever. If I was the Camaro owner, and I cut my losses and sold the car for cheaper, I wouldn't make the guy keep paying me. There was no money out fo pocket to fix the car, and he lost money on the sale because he didn't want to wait, I don't see how it's the truck (assuming) drivers responsibility anymore.

Now, that said, if the car was t-boned like mentioned above, I would still expect payments. The point I'm making is the payments would be for repairs of damages, if the damages weren't repaired, why is there a charge?

Tell your friend that owes the money that real men pay what they owe. Big flippin deal that they other guy sold his car. That is none of yours or his business. It isn't like you bought part ownership of his car by hitting it. If that were the case, I would find the next Ford GT I see and plow it.

+1 - or be required to pay the difference between the amount he sold it for and the amount it would have sold for if it was not damaged. Just because someone sold the property does not negate a liability. When Visa comes knocking on your door do you tell them to go pound sand b/c you sold that $1000 stereo you charged on their card? Obviously not.

I can't believe anyone would say that the guy shouldn't pay all of what he owes. If the Camaro guy found another car he really wanted why shouldn't he be able to sell is car and get what he wants? He shouldn't be limited in his choices just because some moron smashed his car. Pay it all man.
