Your story about the woman killing the EMT's is probably not the entire story. They say they will not be seeking CRIMINAL charges, traffic citations are not criminal charges and a wet reckless is a citation only, it goes on your driving record not a criminal record like a felony.

My wife a few weeks ago caused an accident. She was cited for the accident and the Trooper said there's typically two citations they give out when your at fault of an accident and it's either a) speeding to fast for present conditions or b) reckless driving. She got option A even though she was driving below the posted speed limit. In WA it's against the law to be at fault in an accident!

No such thing as a "wet and reckless" here in Iowa. If you are pulled over for reckless driving, and you have alcohol in your system, but you blow below .08, then you will only be cited with a reckless. Same goes for Nebraska.

Wet and reckless is a plea to a charge of reckless driving that was alcohol related. Wet and reckless is a plea used to reduce the charge of drunk driving when the amount of blood alcohol was borderline illegal, there was no accident, and there is no prior record for the driver of the motor vehicle.

.038 wouldn't be borderline either. I would say anything thing as .04 and over would be what they count as "borederline". .03 is cough medicine level. This charge is basically a step under a DUI. Some insurance companies still see it as a DUI.

Oh... and a DUI IS a criminal charge, not just a traffic violation.

I did. I was 16 and my first car was a 1969 Chevelle. 350, auto, 4:10 posi.
2 months later I had no license. Exhibition of Speed, Drag Racing...and I was racing my brother in his 1970 Camaro. Needless to say, it wasn't a fun ride home.

I can honestly say, I have never. I got pulled over for it once, like 8 years ago, when I was 18. It got dropped in court.

I stand corrected, a simple reckless is a misdemeanor offense.

Found this online, obviously all states will vary a little.

Reckless Driving Charges

Some State traffic laws define “reckless driving” as including the following types of acts:

Driving 25 miles per hour or more over the posted speed limit
Racing with another vehicle
Trying to elude a police officer
Operating after dark without headlights
Inattention due to cell phone use or message texting
Passing another vehicle on a two lane highway where visibility of oncoming traffic is limited.

Reckless driving charges are generally a misdemeanor crime. Constitutional rules apply to prosecutions for reckless driving such that a prosecution must prove its case beyond a reasonable doubt and Miranda rules apply concerning police officers and the accused right to be informed of his right to remain silent before being interrogated by police concerning the incident.

I asked an officer that I know about this the other day, he said down here in NC I "technically" didn't break any laws, and that it wouldn't be considered "reckless" unless I spun tire.

Here they apparently call it "digging in" if you spin the tires or get that burn out mark.

Though the friend who got the ticket for it I wouldn't trust. He tried to convince me his v6 mustang was a v8 because he had it bored larger..? On top of that he says it's turboed which I have yet to see or hear.

I got a ticket up here in IL when I was 17 in my moms baby blue dodge caravan for "improperly squealing of tires" apparently the response "what's the proper way to squeal my tires?" was not appreciated.

The fact of the matter remains. You can quote all of the technical definitions and have all of the internet battles on the subject you wish, but in the end, it's going to be up to the officers discretion if and how he would like to charge you and the courts discretion if they want to convict you.

Best way to avoid either....don't get caught ing around in the first place!

I'm guilty on all accounts. But i did lose my license back in 92 for 6 months for drag racing. My buddy got caught and said we were racing. Instant loss of license in PA. I was a young dude driving a brand new all white Mustang GT. Cop magnet in my small town. Probably couldve fought it and won as it was hearsay, but again, I was young and didnt know any better.

Now, you dont suppise I drove during those 6 months. : nono:

If you're a minor and drink nyquil or some other medicine that is the like and go for a drive and get Breathalyzer you will go to jail. 0 tolerance rule for minors.

Kind of stupid, I think it should be in consideration of what was consumed or a lower level such as .03.

On a side note, today I was in a friends car and he raced an rx-8 and toasted it.
On another side note, I raced my friends kia optima and toasted it.
