Just recently here in Indianapolis a woman blew a red light and t-boned an ambulance, killing both EMTs inside. Her BAC was .038, under the legal limit of .08. They are NOT pursuing criminal charges on her. If you're under the limit, you're following the law. 2 beers for a full size adult man is unlikely to put him over the limit.
First off I said he could "probably be cited", I didn't say definitely or for sure.
In states like CA and WA they can still charge you even if you're below the "legal" limit. If you have alcohol on your breath and you get in an accident or are driving like an idiot you can likely be charged with a "wet reckless", I know this because my friend has had one and he blew a .04. Your story about the woman killing the EMT's is probably not the entire story. They say they will not be seeking CRIMINAL charges, traffic citations are not criminal charges and a wet reckless is a citation only, it goes on your driving record not a criminal record like a felony.
My wife a few weeks ago caused an accident. She was cited for the accident and the Trooper said there's typically two citations they give out when your at fault of an accident and it's either a) speeding to fast for present conditions or b) reckless driving. She got option A even though she was driving below the posted speed limit. In WA it's against the law to be at fault in an accident!
