OT: Need advice over speeding ticket

I have court on Monday morning for doing 51 in a 30. :bang: I am thinking of just pleading not-guilty and hoping the officer doesn't show up. Then all I'll do is ask the judge to dismiss the case. If he does I'll be back where I started and just have to bend over and take it right? Anyone have any advice? :flag:

Dress up.
Be polite as hell.
Answer everything, "yes sir" or "yes mam."

Cop should show up. Make a case for yourself or just plead "not guilty" and maybe you'll get a lesser fine out of it.

Also, was the cop following you(pacing) or did he/she clock you?

I heard that if he clocks you for your ticket, then when you get to court you can sk to see the last time he had his gun calibrated....if it wasnt calibrated with 30 days of yuo ticket then you get off....but if he can prove he had it claibrated then the judeg will get pissed you tried this loophole....justa a thought

That sucks. I have had three criminal tickets myself. On the last one I got I was going 70 in a 45. I pled not guilty and on my court date I told them my speedometer was off and showed prove that I got it fixed. They dismissed me and told me to be careful next time. I got lucky. My insurance couldn't take another ticket. I am only 18.

PS (My speedometer was never off. I had a shop right me a fake receipt.)

I have heard the same thing if he paces you. Their speedo have to be check too but I don't know how often.

So you guys go up in front of a judge first? We do "appeals court" first, then judge if you lose the appeal and want to try again.

Like punestang said, dress up and be polite. How many tickets do you have already? Alot of times if its your first, they will let you off. Ive had way too many myself, been in danger of losing my license a couple times for 7 moving violations in one year.

I agree. Admit you made a mistake and LEARN from it, don't try to weasel out of it with technicalities. I've had my fair share of run-ins with the law and I never really learned my lesson until last summer I got a reckless driving ticket. That's only a few points away from a DUI. Needless to say I watch my driving extra carefully now and keep my racing to the track.

Here is another idea:

If he was pacing you, ask when was the last time that he inflated his tires and what pressure was used.

I have heard that cabs will deflate there tires so that the diameter decreases and there cab fare goes up. If he does not have any idea when they were inflated, there is probably about a 5% error that he could have.

Also, for future reference, when a cop pulls you over, turn off your radio, be polite and say as little as possible. If he can't remember you when you go to court, it's a lot better. If you do the opposite and talk back, blast your radio and otherwise piss him off, they will be there at court to make sure you fry.

I agree, just pay the damn ticket... You were stupid enough to speed so now pay the price. Go in and plead "no contest" the points will get thrown away but you'll still have the price of the ticket to pay... I think that works every time but I've paid my tickets and delt with it so I wouldnt know for sure. Good luck

Wait if you plea "no Contest" you don't get Points???? I have only fought one ticket and the Officer Did a few things wrong when he pulled me over, for exaplem he said he clocked me, then i asked to see the radar because i was going 15mph under what he said, and he changed his story to he paced me, also the officer pulled me and a friend over and let my freind (girl in a mini van) go for going "65" and ticketed me for going "60"

Thats what I heard will happen if you plea "no contest" .... I have never tried it out but my friend whos taken 3 tickets to court said that was an option you could say... Doing some reading on it might be a good idea though.

well, here in WA, if the cop shows if you subpenia him, you're royally screwed... he can be in a tank top, never had his radar checked, and just hates kids in stangs and the judge will pretty much take his side...

-when you are pulled over, be hella polite, (I always say "thank you" after for some stupid reason...)

-personally, I wouldn't fight it... unless you weren't speeding, but you were, so just pay it...

Try to rescedule for the day before or after the date on the ticket IF possible.. some states won't let you do that. They'll try to rescedule you for a day the officer WILL be there... always try for the day before or after.

Say "In lue of my fine and conviction I request taking driver improvment classes." You'll have to take the class but you'll be out having points and fines tacked on..

I have a few secret methods of getting out of the points that I won't share.. because then they wouldn't be secrets would they.. And they may not work in all states.

Or you can do like I do and just take it becuase you know you were going to fast in the first place.. 50 in a 35??? You had to know you were going to fast.. They'll never believe otherwise.. trust me. Breakin the law.. Breakin the law.. :D

-well put... I never do more than about 8% over the posted limit... so 65 in a 60, 43 in a 40... good method to follow, unless it's a really long open stretch of road w/o anyone and no shoulder :D but that rarely happens...

-and hitman, why tell us you have good secrets, but then don't share them :shrug: what's up w/ that??

FACTS:
Most departments nationwide REQUIRE the officer show up when subpoenad. It is a binding subpoena and cops are likely to be disciplined for not making their appearances.

About radar/laser/speedometer certifications: The law in Florida and most other states requires that every six months the equipment is calibrated. That goes for the speedometer as well. Using tire inflation as an excuse is not acceptable. Tickets are written within parameters such as 6-9 mph over, 10-19 mph over, 20-34 mph over, etc. One mph because of a few pounds of air pressure doesn't make a difference in court. It has never been succesfully tried.

Do not ask the officer to see his certifications or documents before the trial or at all. It is the magistrate or judge's job, by statute, to ensure the officer has his documents. The officer is under NO OBLIGATION to show you anything at ANY TIME, including on the scene of the stop when you ask to see a radar or laser. He or she doesn't have to show you anything but the ticket.

If you were guilty, your best bet is tell the judge or magistrate you plead no contest IF your driving record is clean. You may walk with a fine, maybe school, but no points. If your record sucks, you should have just gone to driving school if available in lieu of a court appearance (unless it's mandatory in your state).

And don't ever waste your money on an attorney, there is nothing he can do for you that you can't do yourself.


So that's my advice, depending on your record, if it's clean, no contest, if it sucks, plead guilty and ask the court if they can show leniency as far as points go. Driving school beats jacked up insurance rates.
