Bought car at dealship, now they want to sue me???

They prob will sue you. Maybe not win tho. Most times a jury will side with the customer, not the dealership.

I agree with you wholeheartedly. Its sad but true fact. Even if the Dealer did nothing wrong If it went before a Judge and Jury he would probably not have to pay it back. Thats basically all I was trying to say.

Give it up.. No we don't. But then again, I forgot. We are supposed to sell cars at invoice, not make a profit, warranty them forever(actually, I have a jeep point, so I do. :rolleyes: ).

I leave you with this advice. Come into my dealership with that attitude and I'm either going to not sell you a car, or give you another reason to hate us. Why not.. You are going to screw me on the survey anyway. Come in and treat me like a human being, and I'll make sure you leave so happy, you send friends to me.

All a dealership's paperwork is written by attorneys. Odds are, he also signed an arbitration agreement. He's going to lose in front of an arbitrator. But I'm sure you are right. What would I know? I've been told everything I know is wrong, and all you customer advocates know more about a car dealership than I do(did you learn this from the internets?). I was even told that I would rather not make money by doing warranty repairs. Good luck OP. I wonder how the person you sold the car to is making out with your problems? You DID give him a warranty and pay half to fix the problem, right?

The guy I sold it too was aware of all issues it had, and since I had to take over a $2,000k lose in 3 weeks, it was worth it to him. What would you do, if a customer calls you less than 24 hours later to tell you there are broken parts on the car? Fix it or say "screw you, not covered" like this place did to me? I can prove in court how much I lost, and all the problems that happened within 2 weeks. Engine taking oil, taking coolant, sun roof broken, both rear windows broke, on and on and on. Fact is, they sold me crap and didn't make it right. My lawyer told me, even if the contract stated half, I could counter sue for all parts and labor for repair on his end since it was a short period of time. Yeah he wrote me a check and I took it, made no profit so I wouldn't end up putting thousdands more into it on a car with 60k miles and owning it only weeks. Dealerships like this need to be shutdown. If the dealership makes it right, then more power to them and they will probably get a return from that customer. This guy bitched through the whole process and didn't know a thing about the car. Call this professional? I think not. I told him the mechanic found metal shavings in the tranny, and he wouldn't take his word for it and tried to mile the contract until it was up. I didn't fully check out things, my fault, but I did have a warranty that clearly covered this stuff so who cares?
 
I know a guy that got his car t-boned and totalled by a young lady that had no insurance or drivers licenses and she had a baby in the car. She sued his insurance company because she got hurt. She won $5000.00

Anymore its not a matter of whos right or wrong. We live in a corrupt society. We all know Dealerships screw people everyday. If he counter sues it would be better off than doing nothing,at least then the Judge has to listen to the whole story. He will likely get nothing out of it. BUT then again the Dealership may not get a penny either. The purpose of counter suing is to allow the Judge to hear both sides of the story and then he will make a decision based on all the facts.

Exactly my point. Do I just sit there and do nothing? I don't think anyone here would. Fact is, put yourself in my shoes. I'm sure everyone in this thread has never done anything like this in their life...
 
He bought the car AS IS. The time to have a problem with an as is car is before you sign and hand over the money. Not after. Also, I don't recall seeing if Mr. poor little customer disclosed the transmission problem to the person he sold it to.. Did you, rocket scientist?

Yes I did. The guy owned three others like it and was aware of all issues. He told me, if the tranny goes out, he'll steal one from his other cars.
 
He shouldnt of given you a check without the recepit first. Most places make you pay for it first then pay you back. Whos to say that you didnt get it fixed and gave the recepit to the person that bought the car to show that it just had work done. Think how many mustangs are sold and pepole give you the recepits to show you whats in the car. Happens all the time. I think your fine just play it cool.
 
What the helll kinda of dealership is this? One of those we finance anyone, any trade running or not? Doesn't sound like anything a reputable dealership would offer, the whole 1/2 payment thing, it's either covered or not from what I've seen.

Do you remember saying this? Which is it?

For what it's worth, when you signed your buyer's order, did you sign any arbitration agreements? Also, how were you notified that the car was sold as is? Did you sign off on it? In NJ, it is LAW that you give a 1 month, 1k powertrain warranty unless you sign it away. What state are you in and I'll check on the laws so if they do sue you, you can hammer them back. Also, post up your experiences at dealerrater.com and ripoffreport.com.
 
Obviously, the OP didn't perform his due diligence as a buyer of a used item before shelling out his hard earned money. Non-functioning windows, low fluids? That is an easy thing to find and a huge "DON'T BUY ME" signal while shopping.
The best thing he can do is be grateful the dealer was dumb enough to cut him a check for half the estimated repairs (whether the repairs were performed or not) and let the legal system figure it out.
By the way, I think that you will be fine in the courtroom. Even Judges/juries have been ripped off on something sometime in their life, and will have sympathy.
OP--I say take this as one of those life lessons and learn from it. Everyone is out to maximize profit on something they are selling. It is upon the purchaser to inspect the item and negotiate price based on the perceived value of said item, in present condition.
Next time take it to a trusted mechanic and pay them to throughly inspect a used car. It will be the best money you will ever spend when buying used.
Let the buyer beware.......

This thread makes me glad the dealership I went was NOT a stealership. Great people, great cars, granted I have only owned it for 6-7 months, but have put 8000 miles or so on it, and have had no issues other than bulbs (OMG they must have known the bulbs were going to go bad) and tires after something popped one (OMG dealership must have put the nail in the road). Your position sucks, but I think morally, you should have paid to have the repair done, after all, that is what the contract was for, half payment to fix the repair, not cut you a $1500 check!

Who cares how much you lost? Buy a ANYTHING new and try to trade it in 1 week later, see how much you lose. It's not a used car thing, trust me.

A contract is a contract... to the best of my knowledge, in your situation you couldn't get out unless you plead incompetence or ignorance to the wording. I doubt you're incompentent. And if the words were too hard to understand than it sucks to be you.

So, you would have taken it up the rear? Contract didn't state it had to be fixed. Does the insurance company force you to fix your car? No...and there's nothing wrong about it.

I checked the fluids and they weren't low when I bought it. The window was my fault. 15 hours go by and they won't fix it....that wasn't wrong either. Fact is, I lost over $2,000 in less than a month and would have lost nearly $5,000 if I fixed it. Best fact is, if I fixed it, it would break again, then what? Keep fixing it? These are known to eat transmissions and at $3200 a pop I wasn't taking any chances.
 
So the fluids all became low within a couple of days of you purchasing the car?? Interesting.
And again if the model of car you chose to buy is known to eat transmissions, why is that the dealers fault? And why would you buy it?? Should researched a little bit, maybe???
Next time take an adult with you to buy a car......
Hopefully losing a couple grand will make you a little more wise the next time you go to purchase a car. You were given a gift in the fact that the bozo paid half towards fixing it before it was fixed.
This is what is wrong with the world today. Everything is always someone else's fault.
learn from it, laugh and go on. there will be other chances to purchase an automobile.
Might as well go ahead a blame the whole thing on the President. I am sure he had a hand in screwing you over.........
