got in trouble for talking in a parking lot

well tonight i saw a nice looking Z28 camaro w/ writing on the window from going to the drag strip at the light i asked, we also did a small run and i got murdered but it was for fun so it didn't bother me, but they said i hade some big balls to race even though i know i would lose. iafter taht we pull into that parking lot, forgetting that you can't be in a schools parking lot after so late, after talking for about 15 min a cop shows up, gets all our info, then another cop shows up.. we still talk and the cop takes about 30 min to get our info and stuff back, i bet he was wondering what was going on. a black convertible z28 camaro and a black convertible mustang gt sitting in a empty parking lot. i talked to the guy and he said all tehy have on teh car is longtube o/r x and a new muffler with turndowns, looked and sure enough that was all i could see, he said he ran a 14 exact does that sound right to yall??

I also wonder waht the cop though when i started my car with or and flows and they started there with or and other type of muffler, bother pretty loud, but his was louder. but sounded very nice i might say, the x gives the car a nice tone..
 
well when the cops came we were like, ohh yeah sorry we forgot that you arn't spoce to be here after hours. and they ran a check to see if we had any warrents, and let us go...

Hmm, is that even legal? Like wouldn't that be considered detaining.... I suppose if you were in a place where you're not supposed to be the cops would say that they are allowed to then (might be, iuno!). Alots of popo are fishy :nice:

Yes it is a form of detention and it's 100% legal I can stop you walking down the sidewalk, hell I can even stop you on your own front porch if I can articulate my reasonable suspicion. It's called a Terry Stop.

It's my favorite because I hate liars and it is one of the few times I can arrest someone for lying. Giving false name and address to an officer is an arrestable offense in my state.

So what if they dont lie, and give you there ID. And simply say am i being detained. And dont answere anymore dumb unrelated questions?

well i keep them there until I am finished with my investigation. But no question I ask is dumb or unrelated. If it were I wouldn't ask it. If they don't want to answer questions that's fine by me. I can stand there all night I get paid whether they talk or not. The quicker they talk the quicker they leave.

In the original instance given in the first post there is more than reasonable suspicion that the crime of Trespassing is occuring. So you have reason for the Terry Stop to find out if anything else is going on. IE. Loitering for the purpose of Narcotics.
In this instance i doubt that was happening but I can garuntee you it crossed the officers mind. But through the questions he asked anfd his observations he felt no need to go any further than check their information for warrants.
 
kinda similar story, minus the involvement of a second car.

a few years back, while i was driving back from a mall with my girlfriend, i had to pull into a parking lot, because she got hysterical over a personal matter, and i wanted to pull over to calm her down some. i parked in an abandoned night clubs parking lot at about 5 pm, facing the street and id say, in 5 minutes, a state trooper pulled up behind me, pulling me out of my truck, searching it, and questioning my girlfriend.

Trespassing on public property?

a school isn't exactly public property after hours even uring regular hours.
One must show a valid reason for being there. Just hanging out in the parking lot after hours is not a valid reason to be there. Hence the possibility for being arrested. In this case would I have arrested nope. But if I got even the smallest thought of drug activity. You are for sure I would have arrested. Why because search incident to arrest is a wonderful thing:nice:
Find much more dope search incident to arrest than I do from plain view. Now plain smell is a pretty good one for marijuana but not other narcotics.
