Well I was just on my way home and I was going from a speed limit 40 into a 50. I was in the 50, And my speedo said 50. But this is the thing. My speedo sticks alot so Im not always sure if its right. I was actually saying to myseld right before I even saw the cop that I was going to pull the cluster and fix it tommorrow after work. Well I saw the cop, looked in my rearview, and saw brake lights. He caught up with me a little down the road, told me to get out of the car, I got out, gave him my stuff, and he told me I was going 59 in a 45. I knew he was wrong already because there is no area on that road that has a speed limit of 45, its either 40 or 50. I didnt say anything thing though. Then he wrote out the ticket and told me I can call this number to call the DA's office to see how much it is. I told him "Yea I actually have that number in my phone cause my dad is the Assistant DA" He kinda nodded his head and looked dissapointed. I more than likely was going 59, but my speedo said 50 (Im gonna fix that tomm like I said) BUT he said it was a 45 wich is NOT true.
After I told him my dad was the assistant DA he said well I guess you can just call him tommorrow then. And kind of chuckled.
So basicaly I am going to get it fixed, but even if I couldnt I could go to court and get it thrown out becasue he got the speed limit wrong.

Nice,

I'm not a cop-hater or anything, but nothing is worse than law officers who don't know the law.
I didnt really care that he pulled me over. I told him "have a good night" when I was getting back in my car, but he could atleast get his facts straight.

Would have been priceless if there was a speed limit sign saying 50 in the other direction you could have pointed to just after he said that. He probably would have let you go, out of embarasment.

I kinda had the same thing happen to me. I was in my moms Volvo wagon doing 70 in a 55 with my friend in his 95 Cobra and we were both pulled over. My policeman wrote 70 in a 65 instead of 55, and then gave me the price for 15 over. I took it to court, told the judge he wrote the wrong price and ended up paying like 70 bucks instead of like 220.

If ANY facts are wrong ON THE TICKET, it can (should) all be thrown out with a "Sorry we wasted your time". Cops NEVER let people go because of their own embarrassment. Just won't happen.
Did he write "45" on the ticket? If so, the whole thing is inadmissible. On the grounds that "If he got one fact wrong, how many others did he get wrong?"
Sounds like you have it in the bag, though. Hahahaha!

Of course you don't, you're dad is the ass. DA. You can get away with murder.
Yea, thats pretty much it, I knew id get it fixed, but him messing it up like that was just the icing on the cake.

I called my dad and told him about the 45 thing and he said that if we WOULD take it to court, which we wont, Ill just bring it to the cheif of police and never hear about it again, then we could jsut say "Well if he cant read a big Speed Limit sign, what makes you think he can read a little radar gun?"

I was riding with my friend and we got pulled over one time, the SL on the road was 55, but he said we were going 66 in a 45, and we were like, no dude, its 55; and we sat there arguing with him for a few minutes until we got him to go look at the sign that said it was 55, then he tore it up and wrote it for 66 in a 55 my friend and the cop both got :owned:

you should've left it at 45mph and had it thrown out like Green said.:bang:

Sorry but one mistake on a ticket does not make it inadmissable or automatically get a ticket thrown out. No offense but that's silly.

It probably is good advice to always appear in court and challenge a ticket with whatever reasonable position you have. And pointing out mistakes should help some. But even a mistake about the posted speed limit won't guarantee you anything.

All true. But I would advise not to bring up the really frivilous stuff -- e.g. "it's NE Whatever Rd, not SE like he wrote" will just annoy the judge.

I wouldnt be posting about how you got a ticket thrown out just cause of who your Dad is. Just a little advise.

Mark
that had nothing to do with the ticket getting thrown out. It got thrown out because the cp didnt even know the speed limit.

I bet he hates cocky kids like you. "Oh but my dads this and that". I'll get this fixed. It must be nice but one day whenever daddy isn't around your not gonna be able to get out of trouble.

Sorry but I hate cop/judges/ect sons. I've never met one that wasn't a cocky ******* who think he owns the world and can do anything he wants.

Well Ive never been known to be cocky. And I dont know about where you guys live but in my town, ANYONE can go to the DA's office after getting a ticket and say "What do I need to do to have this not on my record and get a reduced fine?"
Usually they will give you comm service and thats about it. But most peopel just dont even bother with that. the fact that Im the Assistant DA's son just makes me not have to go through so much crap. Ill prolly still have to do some comm service, but I more than likely wont have to pay anything since they know Im a broke college student.
